It is a proviso contained in leases empowering the lessor to re- enter upon the demised premises for breach of the covenants contained in the lease , especially for non- payment of rents. The term is applicable only to real estate originally for the reason that only real estate was capable of livery of seisin , and is inapplicable to an incorporeal hereditament .
