Meaning of Life Estate
An estate held for the life of the party holding same or for some other person or persons. In the latter case, the estate is called an estate pur autre vie . In re Smvthe’s Estate, 282 P.2d 141, 132 C.A.2d 343. A life estate is an estate of freehold in that it is of uncertain duration but it is not, an estate of inheritance . A life estate may be created by grant , or devise or by operation of law such as dower and curtesy . A dower being the life estate in one third of the lands and tenements which the husband was beneficially seised of an estate of inheritance at any time during marriage which the wife takes upon the death of her husband. Mayburrv v Brien, 10 L. Ed. 646. Curtesy is the life estate which a husband takes on the death of the wife in the lands and tenements of which she was seised of an estate of inheritance. Wilmington trust Co. v Boden, 28 Del. Ch. 106, 38 A.2d 168. there is also said to be another form of life estate known as a tenancy in tail after a possibility of issue extinct. “A life life estate (more in the U.S.) is an interest in real property (more in the United States here), the duration of which is limited by the life of some person. Such person may be the party creating the estate (see worldwide), the tenant himself, or some other person or persons. It may be for an indefinite period which may last for a life. It is of no consequence how uncertain the duration of the estate may be. If it can or may continue during a life, it is a freehold or life estate (more in the U.S.). It outranks an estate (duration) for hundreds of years, because it is said that no one knows how long a man may live. . . It is held that a life life estate (category) in land (more in the U.S.) is `real property,’ enabling the owner (more in the United States) to sell or encumber it, and, if it be nonexempt property, it may be attached for the owner (more in the United States)‘s debts or levied upon by execution and sold.” Smith v. Planning & Zoning Board, 3 Connecticut (provision)App. 550, 553, 490 A.2d 539 (1985).
