Meaning of Judgment Lien

A lien on property , arising from the operation of law as a result of judgment rendered by a court of record . Not a lien known to common law but one created by statutes. See Morsell v First Nat. Bank, 91 U.S. 357, 23 L.Ed. 436. The origin of a judgment lien is said to be the statute de Mercantoribus and the Statute of westminster , both of England. See Snead v M’Coull, 12 How. 407, 13 L.Ed. 1043. Whether or not a judgment becomes a lien without the delivery of an execution to the sheriff depends upon the statutory provisions prevailing in each jurisdiction . Generally, however, a judgment becomes a lien from the time it is rendered or notice thereof is filed in the registrar ‘s office of the county where the property is situated. See Fogg v Blair, 133 U.S. 534,10 S. Ct. 388,33 L.Ed. 721. Judgment liens do not extend beyond the state where the judgment is rendered. See Wisconsin v Pelican Ins. Co., 127 U.S. 265, 8 S. Ct. 1370, 32 L.Ed. 239. A judgment lien is not property or right in land although it confers a right to levy on land to the exclusion of other adverse interests acquired after judgment. See Baker v Morton, 12 Wall. 150, 20 L.Ed. 262. Also see judicial lien .
