Meaning of Invitee

One who comes upon land or enters a building by the invitation of the occupier. The invitation does not have to be direct but can be implied such as that given by a church , theater, mail, etc. The test to determine whether a person is an invitee or not is twofold, (1) the ecoÂnomic benefit theory which accords the status of an invitee on a person entering premises on business which concerns the occupier; (2) the other is the invitation test under which a person becomes an invitee if the occupier, expressly or impliedly, has led such person to believe the premises were intended to be used by visitors for the purpose which he is pursuing and if such use was not only acquiesced in by occupier but was in accordance with intention or design for which the place was adapted and prepared. An occupier owes the duty to use reasonable and ordinary care to keep premises safe and to protect the invitee from injury caused by unreasonable risk which the invitee himself, in exercise of ordinary care for his own safety will not discover. The basis of this doctrine is known as the rule in Indemaur v Danes, L. R. I C. P. 274 and has been followed in the United States . See Restatement of Torts 2d §332.
