Definition of Investment
In relation to social issues, a meaning of investment is provided here: purchase of tangible assets, such as machines, factories, or inventories that are used to produce goods and services for the purpose of making a profit.
Investment in Global Commerce Policy
In this regard, investment is: a stake in a business, a company or an enterprise. Many definitions exist. The following are some examples. The 1961 OECD Code of Liberalisation of Capital Movements defines direct investment as “investment for the purpose of establishing lasting economic relations with an undertaking such as, in particular, investments which give the possibility of exercising an effective influence on the management thereof by means of (1) creation or extension of a wholly-owned enterprise, subsidiary or branch, acquisition of full ownership of an existing enterprise, (2) participation in a new or existing enterprise, and (3) a loan of five years or longerâ€. The Energy Charter Treaty, concluded in December 1994, defines investment as every kind of asset, owned or controlled directly or indirectly by an investor. The entries on trade policy are here. It includes (a) tangible and intangible, and movable and immovable, property, and any property rights such a leases, mortgages, liens and pledges, (b) a company or business enterprise, or shares, stock, or other forms of equity participation in a company or business enterprise, (c) claims to money and claims to performance pursuant to contract having an economic value and associated with an investment, (d) intellectual property, (e) returns, and (f) any right conferred by law or contract or by virtue of any licences and permits granted pursuant to law to undertake an economic activity in the energy sector. NAFTA, which entered into force on 1 January 1994, defines investment as (a) an enterprise, (b) an equity security of an enterprise, (c) a debt security of an enterprise where the enterprise is an affiliate of the investor and the original maturity of the debt security is at least three years, (d) a loan to an enterprise which is an affiliate of the investor and where the original maturity of the loan is at least three years, (e) an interest in an enterprise that entitles the owner to share in income or profits, (f) an interest in an enterprise that entitles the owner to share in the assets of that enterprise on dissolution, (g) real estate or other property, tangible or intangible, acquired in the expectation or used for the purpose of economic benefit or other business purposes, and (h) interests arising from the commitment of capital or other resources in the territory of a party to NAFTA. The Agreement between Japan and the Republic of Singapore for a New-Age Economic Partnership defines investment as every kind of asset owned or controlled, directly or indirectly, by an investor, including (i) an enterprise, (ii) shares, stocks or other forms of equity participation in an enterprise, including rights derived therefrom, (iii) bonds, debentures, and loans and other forms of debt, including rights derived therefrom, (iv) rights under contracts, including turnkey, construction, management, production or revenue-sharing contracts, (v) claims to money and claims to any performance under contract having a financial value, (vi) intellectual property rights, including trademarks, industrial designs, lay-out designs of integrated circuits, copyrights, patents, trade names, indications of source or geographical indications and undisclosed information, (vii) rights conferred pursuant to laws and regulations or contracts such as concessions, licences, authorizations, and permits, and (viii) any other tangible and intangible, movable and immovable property, and any related property rights, such as leases, mortgages, liens and pledges. The entries on trade policy are here. Amounts yielded by investments, such as profit, interest, capital gains, dividends, royalties and fees are also considered investments under this agreement. The working definition used by the participants in the negotiations for the Multilateral Agreement on Investment, which were abandoned in early 1999, states that investment means every kind of asset owned or controlled directly by an investor, including (i) an enterprise (a legal person, whether or not for profit, private or government-owned or –controlled, including a corporation, trust, partnership, sole proprietorship, branch, joint venture, association or organization), (ii) shares, stocks or other forms of equity participation in an enterprise, and rights reserved therefrom, (iii) bonds, debentures, loans and other forms of debt, and rights derived therefrom, (iv) rights under contracts, including turnkey, construction, management, production or revenue-sharing contracts, (v) claims to money and claims to performance, (vi) intellectual property rights, (vii) rights conferred pursuant to law or contract or concessions, licences, authorizations and permits, and (viii) any other tangible and intangible, movable and immovable property, and any related property rights, such as leases, mortgages, liens and pledges.
