English Legal System: Declaration of Trust
In the context of the English law, A Dictionary of Law provides the following legal concept of Declaration of Trust : A statement indicating that property is to be held on trust. No specific words are necessary, as long as the intention to declare a trust is made clear. Once a declaration of trust is made, the person intended to be trustee still holds the property but is not entitled to hold it for his own benefit. A declaration of a trust where the trust property is land is subject to certain formalities, detailed in the Law of Property Act 1925 (s.53).
