All the laws which prevailed among the Romans and in particular the law of Justinian. See civil law .

In a general sense, this comprehends all the laws which prevailed among the Romans, without regard to the time of their origin, including the collections of Justinian (now generally denominated the “civil law”). 1 Mackeld. Civ. Law, 9, § 18. In a more restricted sense, the Germans understand by this term merely the law of Justinian, as adopted by them. Id. note. In England and the United States, however, there seems a propriety in limiting its application to all the laws of the times anteROMESCOT rior to Justinian, distinguishing the collections of that emperor by the term “civil law.” Butler, Hor. Jur. 30. It is clear that a large portion of the Roman law was excluded from the Corpus Juris Civilis.
