Meaning of Worthier Title
At common law where testator undertook to devise to an heir exactly same interest in land as such heir could take by descent, descent was regarded as worthier title and heir took by descent rather than by devise. See Jones v. Petrie, 132 P.2d 396, 156 Kan. 241.
