Meaning of Water

Water is generally viewed as part of the land upon which it is found. It is thus considered real property as opposed to personal property. The common law of England upon the subject of grants of land bordering on the sea at the time of the immigration of the English to the United States is the law of the United States except insofar as modified by the charters, constitutions, statutes and usages of the states and the federal constitution and laws. See Shively v Bowlby, 152 U.S. I, 14 S. Ct. 548, 38 L.Ed. 331. Waters may be classified as private or public. All navigable waters are public in their nature. State v Korrer, 127 Minn. 60, 148 N. W. 617. Lakes and ponds which are non navigable and the beds and shores thereof, in most jurisdictions, belong to the owners of the soils adjacent to the same. Hardin v Jordan, 140 U.S. 371, 11 S.Ct. 808, 35 L.Ed. 428. In some jurisdictions, such ownership extends to lakes which are navigable as well. See Hilt v Weber, 252 Mich. 198, 233 N. W. 159. Where it is public waters, it is owned by the state bordering thereon which owns the bed of the waters in trust for the benefit of its people, to preserve to them forever the enjoyment of the waters. See Utah v United States, 403 U.S. 9, S. Ct. 1775. 29 L. Ed.2d 279.
