Meaning of Trade Name

A word, name, symbol , device or any combination thereof in any form or arrangement used by a person to identify his business , vocation or occupation and distinguish same from the business, vocation or occupation of others. See uniform Deceptive trade Practices Act §1(8). The use of a trade name, in addition to distinguishing the product of the particular person or organization, also serves to secure the advantages of a good reputation and good will. See American Steel Foundries v Robertson, 269 U.S. 372, 46 S.Ct. 160, 70 L. Ed. 317. In addition, a trade name may become established in respect of an article which has been known for a long period under that name during which it was produced by only one manufacturer and the primary significance of the trade name in the minds of the consuming public is not the product but the producer. See Kellog Co. v national Biscuit Co., 305 U.S. 111,59 S.Ct. 109, 83 L.Ed. 73.
