Meaning of Trade Mark

A distinctive sign, device or mark of authenticity, through which the products of a particular person or organization are distinguished or distinguishable from those produced or dealt in by others. See Elgin Nat. watch Co. v Illinois Watch Case Co., 179 U.S. 665,21 S.Ct. 270; also, Beech-Nut Packing Co., v P. Lori/lard Co., 273 U.S. 629, 47 S.Ct. 481, 71 L.Ed. 810. A mark used by a person to identify goods and to distinguish them from the goods of others. See uniform Deceptive trade Practices Act §1(7). A mark is a word, name, symbol , device or any combination thereof in any form or arrangement . See Uniform Deceptive Trade Practices Act §1(4). The trade mark laws are intended to protect the right of the owner of trademark to enter related fields in future, protect good reputation associated with owner’s mark from possibly inferior merchandise of others using same or similar marks, and to protect the public from being misled by confusingly similar marks. See Scarves By Vera Inc., v Todo imports , Ltd., (C.A. 2) 192 U.S. P.Q. 289.
