Meaning of Torrens’ System

A system of registration of transactions relating to interest in lands, first introduced in Australia in 1858 at the instance of Sir Robert Torrens. This system has been introduced into many jurisdictions in the United States by state Statutes. The purpose of these statutes is to provide security of title and protect those dealing with real property , the title to which has been certified thereunder. See Carlson v Carlson, 124 Cal.App. 207, 12 P.2d 165. Generally, these statutes provide for a judicial proceeding to settle title and to issue certificates of title showing thereon the status of the title, with all liens, encumbrances and claims against same and to protect the registered owner against all claims or demands not noted on the book for registration of titles.
