Meaning of Tales de circumstantibus
(Lat. a like number of the bystanders). A sufficient number of jurors selected from the bystanders to supply a deficiency in the panel. The order of the judge for taking such bystanders as jurors. Whenever, from any cause, the panel of jurors is insufficient, the judge may issue the above order, and the officer immediately executes it. See 2 Hill (S. C.) 381; 2 Pa. St. 412; Coxe (N. J.) 283; 1 Blackf. (Ind.) 63; 2 Har. & J. (Md.) 426; 1 Pick. (Mass.) 43, note. The number to be drawn on successive panels is in the discretion of the court. 17 Ga. 497.
