Meaning of Restraint Of Marriage

A clause in a will or a deed that is in restraint of marriage is void as offending public policy . However, a restraint on marriage which is a condition precedent to a contract or a devise taking effect is valid while a restraint which is condition subsequent is void. The restraint of a second marriage, however, is good in law.
