Meaning of Residence

It has been said that the word residence is one of flexible import and that its meaning depends upon the context. See Sheppard v finance Associates of Auburn, Inc., 316 N.E.2d597, 366 Mass. 182. It is the place where one actually lives or has his home; the person ‘s dwelling place or place of habitation; an abode ; a dwelling house . Generally, a corporation has a residence wherever it conducts its ordinary business . Natl. Truckers service , Inc. v Aero Systems, Inc., (Tex. Civ.App.) 480 S. W.2d 455. Residence is to be distinguished from domicile which latter term includes residence and is generally regarded as the place where a person has his fixed and permanent home or residence to which he intends to return whenever he is absent therefrom; it is not a residence for any special or temporary purpose but one intended to be permanent for an unlimited or indefinite period . See In re Daniels estate , 193 N. W.2d 847, 53 Wis.2d 611. A person may have only one domicile while at the same time maintain two or more residences. See Lafleur v Seaboard Fire and Marine Ins. Co., (La.App.) 296 So.2d 860. However for certain statutory purposes, as under domestic Relations Law, the term residence may be synonymous with domicile. See Pierce v Pierce, 376 W. Y. S.2d624.

Residence Alternative Definition

(Lat. resedeo). Personal presence in a fixed and permanent abode. 20 Johns. (N. Y.) 208; 1 Mete. (Mass.) 251: 105 Mass. 93; 23 Wis. 607. A residence is different from a domicile, although it is a matter of great importance in determining the place of domicile. 13 Mass. 501; 5 Pick. (Mass.) 370; 1 Mete. (Mass.) 251; 2 Gray (Mass.) 490; 19 Wend. (N. Y.) 11; 11 La. 175; 5 Me. 143. See “Domicile.” “Residence” and “habitancy” are usually synonymous. 2 Gray (Mass.) 490; 2 Kent, Comm. (10th Ed.) 574, note. “Residence” indicates permanency of occupation, as distinct from lodging, or boarding, or temporary occupation, but does not include so much as “domicile,” which requires an intention continued with residence. 19 Me. 293; 2 Kent, Comm. (10th Ed.) 576.
