Meaning of Receiver
A person duly appointed by a court of competent jurisdiction to collect and receive pending the action in which he is so appointed the rents, issues and profits of land or the produce of personal estate or other things in question , which it does not seem reasonable to the court that either party to the action should collect or receive, or where a party is incompetent to do so, as in the case of an infant . He can only be appointed for the purpose of getting in and holding or securing funds or other property which the court after the trial or in the course of the action, will have the means of distributing amongst or making over to the person or persons entitled thereto. Once appointed he becomes an officer of the court and is not a representative of the plaintiff or the defendant . He is not to be interfered with or dispossessed of the property he is directed to receive by anyone although the order appointing him may be erroneous . Davis v Gray, 83 U.S. 203, 21 L.Ed. 447, 16 Wall. 203. The possession of a receiver is that of the court, and he holds, pending the suit, for the benefit of whomsoever it shall in the end be found to concern, neither the title nor the rights of the parties being changed by the possession of the receiver. grant v Phoenix Mut. Life Ins. Co., 106 U.S. 429,1 S.Ct. 414, 27 L.Ed. 237. Any attempt to disturb his possession amounts to contempt of court . Wiswall v Simpson, 55 U.S. 52,14 How. 52, 14 L.Ed. 322.
