Meaning of Real Party In Interest

Generally it is a requirement that every action must be prosecuted or defended in the name of the real party in interest . In this context, the term denotes a party who is benefitted or injured by the judgment in the case; one who by substantive law has a legal right to enforce or resist the claim in question . One who is entitled to the proceeds of the claim in litigation or one who has the duty sought to be enforced or the duty sought to be enjoined. See reliance Ins. Co. v Walker, 234 S.E.2d206, 33 N.C.App. 15.
