Meaning of Public Lands

Such government or state lands as are open to public sale or other disposition under general laws, and which are not held back or reserved for any governmental or public purpose. Also been held that the phrase is synonymous with public domain. Wallis v Pan American Petroleum Corp., 384 U.S. 63, 86 S.Ct. 1301, 16 L. Ed.2d 369. The government, be it federal or state, is the owner in fee simple of public lands. See Schel! v White, 80 Ariz. 156, 294 P.2d 385.
