The following is a definition of “Prima Facie”, produced by Tetley, in the context of admiralty law: (“at first sight”) a rule whereby a particular fact constitutes evidence of a state of affairs, unless contradicted by other stronger, admissible evidence. See, e.g., the Hague and Hague/Visby Rules (see this maritime law term in this legal dictionary) art. 3(4), under which the issue of a clean bill of lading (see this maritime law term in this legal dictionary) is prima facie evidence of the receipt by the carrier (see this maritime law term in this legal dictionary) of the goods as described in the bill, and the similar provisions of the Hamburg Rules (see this maritime law term in this legal dictionary) art. 16(3) and of the Pomerene Act (see this maritime law term in this legal dictionary), old sect. 22 (49 U.S. Code sect. 102, now 49 U.S. Code sect. 80113(a).
