Meaning of Preventive Justice

At common law . Justices of the peace have always had jurisdiction , at their discretion , to bind over a man, not because he has committed an offense but because they think from his behavior that he may commit offenses against the peace, or that he may cause others to commit such offenses. Consists in obligating those persons whom there is probable ground to suspect of future misbehavior to stipulate with and to give full assurance to the public that such offense shall not happen by binding pledges or securities for keeping the peace or for their good behavior.
