Meaning of Non-joinder

The failure to join all persons who are necessary or proper as parties to an action . The failure to include as parties to an action, in addition to those named , someone else who has a vital and direct interest in the controversy and whose interest cannot in law be severed from those named in the suit. In the case of such non joinder the court cannot proceed with the action. See Gregory v Stetson, 133 U.S- 579, 10 S.Ct. 422, 33 L.Ed. 792.
