Meaning of Newly Discovered Evidence

evidence that is discovered after a trial which could not have been discovered beforehand even with a diligent effort which is not merely cumulative or of an impeaching nature but which is material and likely to change the prior verdict at a new trial . state v Carsetti, 306 A.2d 166, 111 R.I. 642. Such evidence as was existing at the time of trial but of which the aggrieved party was then excusably ignorant. Wilkes v Iowa State highway Comm., (Iowa) 186 N. W.2d 604. The term does not refer to facts that occur subsequent to the trial. See Fox v First Western Sav. & Loan association , 470 P.2d 424, 86 Nev. 469.
