Meaning of Misconduct

Any transgression of some established and definite rule of action , a dereliction from duty, unlawful behavior , wilful in character , improper or wrong behavior. In the context of employer -employee relationship, the term denotes an intentional or deliberate wrongful act or wanton negligence or neglectful failure in performance of his duties by an employee. See appeal of Moore, 560 P.2d67, 28 Or.App. 637. In relation to attorneys, the term denotes a dishonest act or attempt by counsel to persuade court or jury by use of deceptive or reprehensible methods. See People v Johnson, 114 Cal. Rptr. 545, 39 C.A.3d 749.
