Meaning of Lodger
One who is a tenant of a part of a premises that is in the possession of the landlord ; the lodger has the exclusive possession of the part that he is occupying. The owner of the premises in such a case retains direct control , supervision or care of the entire premises. See Osborn v Brown, (Ala.) 361 So.2d 82.
Lodger Alternative Definition
One who inhabits a portion of a house of which another has the general possession and custody. It is by this retention of general possession and control by another that a “lodger” is distinguished from a “tenant.” 40 L. J. C. P. 188; L. R. 6 C. P. 360. A lodger has no interest in the real estate. 117 Gal. 71. It is difficult, in the present state of the law, to state exactly the distinctions between a “lodger,” a “guest,” and a “boarder.” A person may be a guest at an inn without being a lodger. 1 Salk. 388 ; 9 Pick. (Mass.) 280; 25 Wend. (N. Y.) 653; 5 Sandf. (N. Y.) 242; 16 Ala. (N. S.) 666; 8 Blackf. (Ind.) 535; 14 Barb. (N. Y.) 193; 6 C. B. 132. And boarder includes one who regularly takes his meals with, and forms in some degree a part of, the householder’s family, 25 Eng. Law & Eq. 76.
