Meaning of Levy
As a verb, means to collect, or obtain money by seizure . As in the expression to levy execution , meaning to realize a sum of money by a writ of execution against the property of a judgment debtor . As a noun it denotes the act of raising or collecting money by seizure. The word may also be used in reference to either legislative or administrative function of taxation . See Alpha Beta Acme Markets, Inc., v City of Whittier, 68 Cal.Rptr. 327, 262 C.A.2d 16. In the case of goods and chattels , in order to constitute levy, there must be an actual seizure and continued possession thereof in the sheriff . A levy requires that property be brought into legal custody through seizure, actual or constructive , levy being an absolute appropriation in law of the property levied on and a mere notice is insufficient. See U.S. v O’Dell, (C.A.7) 160 F.2d 304.
