Meaning of Inverse Condemnation

Denotes a cause o: action against a governmental agency tc recover the value of property taken by such agency without formal exercise of power of eminent domain . The remedy is designed tc protect the public to insure that a landowner, whose property is taken, receive- just compensation . Not a proceeding tc compel the government agency to returr the property to the owner for the doctrine rests upon the theory that after the property has been devoted to a public use by such governmental agency that it would serioush interfere with service furnished to the public if such use is discontinued. Public polic dictates that such use should not be discontinued and that the property owner shoulc be compensated for his loss. See Garder water Corp. v Fambrough, 53 Cal. Rptr 862, 245 C.A.2d324.
