At common law , a feofment of an estate larger than what the grantor had was totally void as being . tortious conveyance but the Real Proper Act of 1845, in England, provides that. feoffment should not have any tortious operation ; it therefore became an innocent conveyance, such a conveyance is only pro tanto void as to the excess estate conveyed
