Meaning of Inheritance Tax
A burden imposed by government on all gifts, legacies and successions whether of real or personal property or both or any interest therein passing to certain persons ( other than those specially excepted) by will, by intestate law, or by deed or assignment made inter vivos , intended to take effect at or after the death of the grantor . See In re Morris’ estate , 50 S. E. 682, 132 N. C. 259. An excise on privilege of taking property by will or by inheritance or by succession in any other form upon death of owner . See In re Smith’s Estate, (Ohio Prob.) 188 N.E.2d 650. Not a tax on property but on transmission of property from dead to living. Rigby v Clayton, 164 S.E.2d 7, 274 N.C. 465.
