Meaning of Exoneration
A right to be reimbursed by reason of having paid that which another should be compelled to pay. Analagous to indemnity with exception that indemnity is generally based upon contract , express or implied , and means compensation for loss already sustained.
Exoneration Alternative Definition
(1) The taking off a burden or duty; the shifting of a burden from one person or one piece of property to another. Thus, it is a general rule in the distribution of an intestate’s estate that the debts which he himself contracted, and for which he mortgaged his land as security, shall be paid out of the personal estate, in exoneration of the real.
(2) The right of one secondarily liable, who has paid the debt, to recourse in equity against the principal for reimbursement. Pom. Eq. Jur. p. 467, § 1416.
