Meaning of Employer

Any person acting (in the interest ) as an agent of an employer, directly or indirectly, but shall not include the United States or any wholly owned government corporation , or any federal reserve Bank, or any state or political subdivision thereof, or any corporation or association operating a hospital, if no part of the net earnings inures to the benefit of any private shareholder or individual, or any person subject to the Railway labor Act, as amended from time to time, or any labor organization ( other than when acting as an employer), or anyone acting in the capacity of officer or agent of such labor organization. 29 U.S. C. §152 (2).

In the context of the English law, A Dictionary of Law provides the following legal concept of Employer And Employee : The relationship between the parties to a *contract of employment. (It was formerly known as master and servant.) The relationship is governed by the express and implied terms of the contract and by statutory rules that the contract cannot exclude. These relate, for example, to *unfair dismissal, *redundancy, *maternity rights, *trade union membership and activity, and health and *safety at work. On the principle of *vicarious liability, third parties may hold an employer responsible for certain wrongs committed by his employee in the course of his employment.
