discretion is the power to act to one’s own judgment and conscience uncontrolled by the judgment or conscience of others. The discretion of a judge or court is one that is to be exercised judiciously and not arbitrarily. judicial discretion should be directed to doing substantial equity and justice. A Discretionary power is one which is not imperative or, if imperative the time, manner or extent of execution of the power is left to the holder of such power.
