Meaning of Custody

The care and keeping of anything; safekeeping, protection, charge , care, guardianship. imprisonment , as in the words to be in custody. A restraint on one’s liberty . Ordinarily, the status of custody presupposes an arrest for a particular charge and advice by the arresting officer of his intention to arrest, of cause of arrest and of his authority to make same and, normally, a subsequent complaint stating the charge against the arrested person . See People v Manis, 74 Cal. Rptr. 423, 268 C.A.2d653. For purposes of Miranda rights custody means that a suspect is deprived of his freedom of movement. For habeas corpus proceedings, besides physical imprisonment, there are other restraints, remands, liberty, restraints not shared by public generally, which have been thought sufficient to support issue of habeas corpus. U.S. Ex. Rel. Schonblun v Commanding Officer, Armed Forces, (C.A.N.Y.) 403 F.2d371. In relation to children, a custody of child relates to care and keeping and embraces some of the parental rights with respect to rearing of a child. It includes the right to child’s services and earnings and right to direct child’s activities and make decisions regarding child’s care and control , education, health and religion . Trompeter v Trompeter, 545 P.2d 297, 218 Kan. 535.

English Legal System: Custody

In the context of the English law, A Dictionary of Law provides the following legal concept of Custody :

1. Imprisonment or confinement. The current policy behind the use of custody was established in the Criminal Justice Act 1991 and has been consolidated by the Powers of Criminal Courts (Sentencing) Act 2000. There is a twin-track approach, under which long custodial sentences will be levied on very serious crimes, particularly those of violence, but custody may be replaced with “community penalties” (punishment in the community, e.g. reparation in the community) for the less serious ones. The Powers of Criminal Courts (Sentencing) Act 2000 establishes a framework for custodial sentencing that reflects this proportionality principle and includes a policy of reducing prison for non-serious offences. To this end, Section 79 of the Act introduces a “custody threshold” that has to be surmounted before any court can impose a custodial sentence, and section 80 imposes limits on the length of any custodial sentence given

2. (in family law) Formerly, the bundle of rights and responsibilities that parents (and sometimes others) had in relation to a child. “Custody”, which featured in various statutes, has now been replaced by the concept of *parental responsibility introduced by the Children Act 1989.
