Meaning of Contribution

The performance by each of two or more persons jointly liable by contract or otherwise , of his share of the liability . It arises where two or more persons are subject to a common liability other than for fraud or for wilful tort. A sharing of the loss, because of a sharing of causation. See indemnify .

Contribution Alternative Definition

At Common Law. The payment by each or any one of several parties who are liable, in company with others, of his proportionate part of the whole liability or loss, to one or more of the parties so liable upon whom the whole loss has fallen, or who has been compelled to discharge the whole liability. 1 Bibb (Ky.) 562; 4 Johns. Ch. (N. Y.) 545; 4 Bouv. Inst, note 3935. In Civil Law. A partition by which the creditors of an insolvent debtor divide among themselves the proceeds of his property proportionably to the amount of their respective credits. Civ.     In the context of the English law, A Dictionary of Law provides the following legal concept of Contribution :

    The payment made by each of two or more people in respect of damage or a loss for which they are jointly liable. In tort, when two or more people are jointly liable for the same damage and the person injured has recovered his losses from one of them, that person may seek contributions from the other tortfeasors (See civil liability contribution; joint tortfeasors). In the case of a general-average loss (See average), the person who has sustained the loss is entitled to contributions from others with an interest in the property.

    Alternatives definitions of Contribution: (1) The right of one who pays a common liability to recover from the others who share the liability. Example: A, B and C own property. A pays the property tax. A may recover from B and C that portion which B and C should have paid. (2) Decreasing the gifts in a will to pay creditors of the estate or those entitled to a portion of the estate who have been omitted. See also: Abatement.
