As applied in divorce cases, the court would consider a relative degree of misconduct of parties and their relative responsibility for termination of marital relations and award relief against the greater and first offender. The doctrine is frequently invoked in deciding whether or not to award alimony to the wife. See Kivett v Kivett. (Ky.)3I2 S. W.2d 884.
