Facts surrounding or attendant upon the fact or issue in question . See Salter v state , 135 S.E. 408,163 Ga. 80. Facts that have a legitimate bearing on the facts or issue in question. The term is used in this sense while one refers to such matters as circumstances surrounding the transaction or circumstances that go to mitigate a sentence etc.
