Meaning of Child, Children

An infant ; an offspring male or female of human parents; progeny . except as where modified by statute , at common law , the words child or children used in a legal document always meant a legitimate child or children. See In re Bryant’s Will, 110 N. Y.S.2d 485; Potter v Golden Rule Grocery Co., 84 S. W.2d 364, 169 Tenn. 240. Again, the word child occurring in a statute may refer to an infant, that is one who is under the legal age of majority or may mean an offspring that is in its sense correlated to parent . See Watkins v Watkins, (Miss.) 337 So.2d 723. However, in the context of penal statutes relating to juveniles, a child generally means a person less than eighteen years of age. See state v Jackman, (N. D.) 93 N. W.2d 425. Ordinarily when the words child or children occur in a will, unless the context or the manifest intention of the testator requires it, same will be deemed to refer to children of the first degree and not to include remoter dependants such as grandchildren . See Patterson v Alexander, (Tenn.) 509 S. W.2d 834.
