Meaning of Blacklist

A list of persons or organizations marked out for special avoidance, antagonism, censure ; a list of persons, companies or f.r.s. with whom no dealings are to be had. Frequently used in the context of labor hiring practices. Many States have enacted statutes which prohibit blacklisting. See Dick v Northern P. R. CO., 86 Wash. 211, 150 P. 8.

What does Blacklist mean in American Law?

The definition of Blacklist in the law of the United States, as defined by the lexicographer Arthur Leff in his legal dictionary is:

Any list of persons to be punished or avoided, circulated within a particular group. Common examples include lists of employees discharged as “troublemakers” (usually meaning “union organizers”) circulated among employers, and lists of poor credit risks circulated among businessmen. A famous recent blacklist was of people in the entertainment industry suspected of Communist leanings, circulated to, and used by, the radio, television, and movie industry during the height of McCarthyism. The word can also be used as a verb, as in “Dashiel Hammett was blacklisted in the 1950’s.”

    In the context of the English law, A Dictionary of Law provides the following legal concept of Blacklist :

    A list that contains details of members of trade unions, and in particular details of trade-union activists, compiled with a view to being used by outside bodies, usually employers and their associations, for the purpose of discrimination in relation to the recruitment and treatment of workers. The utilization of such lists is subject to the regulatory powers of the Secretary of State under section 3(2) of the Employment Relations Act 1999.
