Meaning of Bastard

A child born out of wedlock ; an illegitimate child

Bastard Alternative Definition

(has or bast, abject, low, base; aerd, nature). One born of an illicit connection. It includes children begotten and born out of lawful wedlock, whose parents do not subsequently marry, and children born in wedlock, but begotten of an adulterous intercourse. A child begotten out of wedlock, but whose parents marry before its birth, is legitimate (62 Iowa, 343; 43 Ohio St. 473; 75 Pa. St. 433), and, by the weight of authority, a marriage after the birth renders -the child legitimate (9 Ala. 965; 85 Ind.. 357; 38 Ky. 170; 20 Tex. 731). The child of a voidable marriage is legitimate (13 Iowa, 198), but, at common law, the issue of a void marriage is a bastard (22 Md. 468; 1 N. J. Eq. 96) ; but by statute in many states, such issue is made legitimate if the marriage was in good faith.

What does Bastard mean in American Law?

The definition of Bastard in the law of the United States, as defined by the lexicographer Arthur Leff in his legal dictionary is:

A term of general abuse, but technically the legal status of a person conceived while his biological parents were not married to each other. More euphemistic equivalents include “illegitimate child,” “child born out of wedlock,” “natural child,” and “love child.”

At common law a child was not a bastard if its parents intermarried at any time before its birth. Under the civil law, following canon law, if the bastard”s natural parent”s at any later time intermarried, the child ceased to be a bastard, but that rule was rejected in England in 1235 and for 700 years thereafter until a statute of 1926. The U.S. situation varies from state to state, but usually conforms by statute to the civil law rule.
